According to the decision of the Constitutional Court of the Russian Federation, the hijackers will be obliged to compensate the material damage to the injured car owner, even if the car was hijacked not for the purpose of further personal enrichment, but from hooligan motives. In court, they argued that the hijackers, having stolen the car and thus deprived of its control of the owner, create favorable conditions for the car to be ousted by third parties, which means that they must answer to the injured party financially.

It is not excluded that such a decision of the COP will allow the State Duma remove from the Criminal Code "hijacking" article and to further consider such crimes as theft. It is worth remembering that today, under the “hijacked” article 166 of the Criminal Code of the Russian Federation, a fine of 120 thousand rubles or the culprit’s annual salary, a three-year restriction of liberty, forced labor, arrest up to six months, and in the most difficult cases, a real term of five years old.
