Early driver's license replacement

There are cases when drivers, not waiting for the end of the term for the replacement of a driver's license, decide to change them in advance. Such cases can be: loss of rights, “fake tags” that are not rarely placed by our “conscientious” DPS officers, well, or just a boring photo on the certificate. It is not forbidden to do this by law, namely, starting from April 5, 2017, any driver may apply to the traffic police to replace the rights.

For early replacement, you will need a medical certificate. If there is no such certificate, then the rights will be given to you, but only for the period for which the old rights were valid. If you provide a medical certificate, then you will be issued a driver's license for 10 years.

It should be noted that obtaining a new driver's license does not require re-passing the driving test.

Fines for untimely replacement of driver's license

If you, for some reason, have delayed the replacement of rights, and do not drive a car, then no one can write out a fine. But if you are stopped by a traffic police officer, and you have expired rights, then it is quite another matter. Such a violation is Article 12.7 of the Administrative Code:Driver's license

  1. Driving a vehicle by a driver who does not have the right to drive a vehicle (except for a driving ride) is punishable by an administrative fine in the amount of five thousand to fifteen thousand rubles.

In this case, the fine may range from 5,000 to 15,000 thousand rubles. This is due to the fact that you do not have the right to drive a vehicle without a driver's license, this is stated in Article 28 of the Administrative Code.

Article 28. Grounds for termination of the right to drive vehicles

  1. The grounds for termination of the right to drive are:

expiration of the established period of validity of the driver's license;

It follows that the replacement of rights after their expiration is in no way a violation and no punishment entails.
